1. INTRODUCTION
1.1 These Terms and Conditions govern the JL Club benefits programme (hereinafter the “Programme” or “JL Club”), owned by JOYERIA JOSE LUIS, S.L. , a company with VAT number ESB15052277 and registered office at Calle Parroquia de Moruxo, Parcela B-41, 15165 - Bergondo, A Coruña, Spain. These Terms and Conditions detail the operation of the Programme. You will have access at all times to the updated Terms and Conditions in force by consulting the JOYERIA JOSE LUIS, S.L. website, in order to be informed of the Terms and Conditions applicable to you at any given time and which you declare to be aware of.
1.2 Membership of the JL Club programme is free of charge and no initial purchase is required to become a member.
1.3 The operation of the JL Club benefits programme is omnichannel, so you may make use of the exclusive benefits and services both in physical stores and online.
2. REGISTRATION IN THE BENEFITS PROGRAM
2.1 Subscription to the JL Club benefits programme can be carried out in two ways, expressly accepting the Terms and Conditions in either case:
2.1.1 Online (E-Commerce):
A registered user of the online store (www.joseluisjoyerias.com) may join the JL Club through the specific section provided for this purpose.
The registration process for JL Club is carried out by entering your mobile phone number, validating it via a code sent by message (SMS or WhatsApp) to that same number and, finally, creating a password. During this process, these Terms and Conditions will be presented to you for your acceptance.
Once completed, the E-Commerce account becomes associated with JL Club and you will be able to enjoy all the benefits mentioned in section 4. Furthermore, you will be assigned a personal and exclusive portfolio of services and benefits, which you can access at any time from the JL Club link on the website. If you are already a previously registered user of the APP, you will not need to register again on the E-Commerce site, but simply log in with your mobile phone number and the password you entered when you registered for the JL Club APP.
2.1.2 In physical stores:
You must download the JL Club APP from the official stores (Apple Store and Android Market). Registration is carried out by entering your mobile phone number, validating it via a code sent by message (SMS or WhatsApp) and creating a password.
During this process, these Terms and Conditions will be presented to you for your acceptance. From this moment on, you will be able to identify yourself in physical stores using the QR code provided by the JL Club APP, as well as view and manage your entire personal benefits portfolio.
If you are already a previously registered user on E-Commerce, you will not need to register again on the APP, but simply log in with the mobile phone number and password you created during the JL Club registration on E-Commerce.
3. CONDITIONS
3.1 By accepting these Terms and Conditions, the user declares to be a natural person, of legal age (18 years or older) and to have sufficient legal capacity to be bound by them. Membership of JL Club for minors is expressly prohibited. Entities or legal persons cannot enrol in JL Club.
3.2 The user declares and guarantees that the data provided during the registration process are truthful, complete and correspond to their real identity.
3.3 JOYERIA JOSE LUIS, S.L. reserves the right to verify, at any time, the age of users who enrol in the JL Club programme by requesting a valid identification document or by any other reliable means.
3.4 Refusal to provide the required documentation or the finding of falsehood in the data provided shall entitle the company to provisionally suspend the user's account and activate the measures provided for in clause 3.4. Enrolment carried out by a minor or through the use of false or third-party data shall be null and void. In such cases, and without prejudice to any legal actions that may apply, the company shall proceed to the immediate suspension and cancellation of the account, the annulment of the benefits obtained and the reversal of points or discounts applied, without this generating any right to indemnity, refund or compensation.
3.5 The User accepts, expressly and without conditions, that access to and use of the “JL Club” programme, its services and the contents of said services take place under their sole and exclusive responsibility.
3.6 For exchanges and returns, the item and its accessories must be in perfect condition and show no alterations.
3.7 Exchanges or returns will not be permitted for items ordered from the workshop, modified items or piercings. The refund of the amount will be carried out using the same payment method used for the purchase and points will be refunded to the user's account.
4. PROGRAMME BENEFITS
4.1 By registering as a member of the JL Club programme, you will be able to enjoy a series of personalised services and benefits:
• Digital Receipt: Digitalisation of the receipt, for both purchases made in physical stores and online.
• Promotions: Exclusive gifts and benefits.
• Publications: News and updates in accordance with your preferences.
4.2 All services are personalised and you may make use of them simply by identifying yourself with the APP/Mobile Pass QR code in the physical store or by purchasing from your online account, having previously registered.
5. PROCESSING OF PERSONAL DATA
5.1 We inform you, regarding the personal data you have provided to us, of the following points:
Data Controller: Your data will be processed by JOYERIA JOSE LUIS, S.L. with VAT number B15052277.
Data: For the proper functioning and operation of the Programme, we will collect personal data consisting of identification and contact details (name, email address and telephone number), authentication data for access to the Programme account, basic transactional data related to purchases made (date, amount and product purchased), data necessary for the administration of benefits (accumulated points and redemptions), as well as IP address, email address, account information and order or behaviour data, mainly for advertising, informative or analytical purposes.
Purposes and Lawfulness: The purpose of processing your data is the management of the JL loyalty club, that is, standardising commercial or other relationships with loyalty club users, managing discounts and promotions associated with the user and building customer loyalty, as well as sending birthday greetings. The lawful basis is the express consent of the user.
Period: Your data will be processed for the time strictly necessary to fulfil the specific purpose or purposes that motivated their collection, until the loss of relevance of their use or, in any case, until they are cancelled in response to the exercise of the corresponding rights by their owner.
Recipients: Your data will not be transferred to third parties, except under legal obligation.

5.3 To create your personal account in the JOYERIA JOSE LUIS, S.L. benefits programme, we have provided a customer page, APP and Mobile Pass so that you can administer and, where appropriate, manage all the benefits and rewards offered, as well as access your purchase history and details about your orders and your membership status.
5.4 To offer you a truly relevant and meaningful experience, we personalise content before displaying it based on what we know about your tastes and preferences. Personalisation is carried out through the analysis and prediction of aspects relating to your interests, preferences, behaviour, etc., using a combination of data from your previous purchase orders and data obtained through the use of cookies and other tracking technologies.
5.5 The telephone number, which must be verified by the user, or other similar means such as email, will be used as a means of communication for sending push notifications, messages (SMS or WhatsApp), or the aforementioned newsletters.
6. CANCELLATION OF YOUR SUBSCRIPTION
6.1 If you cancel your membership of the programme, all benefits, points, discounts and advantages associated with your account will be automatically deleted without any right to indemnity or compensation.
6.2 You may process the cancellation of your membership of the programme through the JL Club website or app. To do so, you must access your account, go to the “Profile” section and select “Unsubscribe”.
6.3 JOYERIA JOSE LUIS, S.L. may, at its sole discretion, alter, limit, modify, suspend or cancel the Programme and/or these Terms and Conditions at any time due to circumstances of force majeure, legal or governmental impositions or otherwise, as well as for business strategy reasons. Whenever circumstances permit, the company will endeavour to notify users of relevant modifications or suspensions with reasonable notice.
6.4 JOYERIA JOSE LUIS, S.L. reserves the right to revoke, freely and without prior notice to that effect, membership of JL Club in those cases where any abuse of the Programme, proven or reasonably assumed fraud, breach of the Terms and Conditions, inactivity of use, any misrepresentation or any conduct detrimental to the interests of the programme or its owner is detected. All of this will affect your eligibility to continue participating in the programme.
6.5 If your membership is revoked, all benefits associated with your personal account will be automatically deleted, without any right to indemnity or compensation.
6. LIMITATION OF LIABILITY
6.1 If you cancel your membership of the programme, all benefits, points, discounts and advantages associated with your account will be automatically deleted without any right to indemnity or compensation.
6.2 You may process the cancellation of your membership of the programme through the JL Club website or app. To do so, you must access your account, go to the “Profile” section and select “Unsubscribe”.
6.3 JOYERIA JOSE LUIS, S.L. may, at its sole discretion, alter, limit, modify, suspend or cancel the Programme and/or these Terms and Conditions at any time due to circumstances of force majeure, legal or governmental impositions or otherwise, as well as for business strategy reasons. 7. LIMITATION OF LIABILITY
7.1 JOYERIA JOSE LUIS, S.L. will use all means at its disposal to offer the correct operation of the JL Club programme. However, the company does not guarantee the uninterrupted, error-free or secure availability of the service at all times, nor its consequences such as loss or damage arising from the suspension, variation, termination or any other case related to JL Club.
In the event of carrying out maintenance, repair, update or improvement operations on the services, JOYERIA JOSE LUIS, S.L. has the right to temporarily suspend accessibility to the Programme without prior notice, notwithstanding which it will endeavour to inform users whenever circumstances permit.
7.2 In any case, the company shall not be liable for damages derived from the JL Club programme that are not a direct and demonstrable consequence of a breach attributable to the company, unless applicable law provides otherwise.
7.3 The above limitations and exclusions shall not affect the rights recognised by the applicable consumer and user regulations nor the liabilities that, by legal imperative, cannot be subject to limitation or exclusion.
8. APPLICABLE LAW AND JURISDICTION
8.1 These Terms and Conditions shall be governed by the laws of Spain. Any dispute, claim or controversy arising out of or relating to these Terms and Conditions or membership of the JL Club shall be resolved by the competent courts in Spain unless otherwise stipulated in applicable consumer protection laws.
8.2 Any nullity that may eventually affect some of these stipulations shall be of an individual nature, not affecting the validity of the other contractual provisions. In that case, the ineffective or unfeasible provision shall be replaced by a new effective or practicable provision.
