Privacy policy

 

When users access the online store and purchase the products it offers, their personal details must be processed.  JOYERIA JOSE LUIS SL guarantees the confidentiality of the personal details provided by users, pursuant to legislation governing the Protection of Data of a Personal Nature and Information Society and Electronic Commerce Services.   

 

 

1.- PROCESSING OF DATA

 JOYERIA JOSE LUIS, S.L, with Spanish Tax Code Number B15052277, provides information through its website www.joseluisjoyerias.com regarding its privacy policy with respect to the processing and protection of data of a personal nature of any customer with which it has a relationship that involves the processing of their data.

 The operations, management and technical procedures that are completed automatically and non-automatically and that allow for the collection, storage, modification, transfer and other actions regarding data of a personal nature, shall be considered as the processing of personal data and, in this case, we inform you of a joint processing in any cases necessary for the management of contracted services and or products from any of the previously indicated businesses, without prejudice of that indicated in section 4 of this policy.

 

 2.- LEGITIMISATION OF PROCESSING

 The basis of the legitimisation of the processing of Personal Data shall be that which results from a contractual or pre-contractual relationship, employment or any other situation that requires the processing of data, such as express consent or legitimate interest for reasons of public health.

 

 

3.- ELECTRONIC COMMUNICATION

  •   In the case of receiving notifications through these means (e-mails, automatic response form messages and other systems of communication) we inform you that the messages are specifically directed to their recipient and may contain privileged or confidential information. If you are not the recipient indicated, remember that the unauthorised use, disclosure and/or copying is forbidden by virtue of legislation in force.
  •  In accordance with that stated in Law 34/2002 of the 11th of July, regarding the Services of the Information Society and Electronic Business, and the Directive 2002/58/CE we inform you that in the case that you do not wish to receive notifications or information of a commercial nature through these means of electronic communication, you may indicate this in the subject “REMOVAL FROM COMMERCIAL NOTIFICATIONS” so that your personal data shall be removed from our database. Your request shall be completed within a space of 10 days from its sending. In the case that we do not receive an express response on your behalf, we shall understand that you accept and authorise our business to continue sending these notifications.

 

 4.- PARTIES RESPONSIBLE FOR PROCESSING:

 In compliance with the legislation in force regarding Data Protection, we inform you that the personal data that you provide us with voluntarily by any of our data collection means shall be subject to automatic and/or manual processing, with JOYERIA JOSE LUIS, S.L being the party responsible for this processing.

 As such, it intends and guarantees to maintain the safety levels for the protection of personal data in accordance with that available in the legislation in force, and which has established the technical means within its reach to avoid the loss, misuse, changing, unauthorised access or robbery of the data provided by interested parties and so that the employees follow these prescriptions, as well as the duty of confidentiality regarding the data subject to the protection and the other obligations of confidentiality in force.

 The data shall be preserved as long as the relationship that produces this processing continues or for as many years as is required to meet legal obligations. Once the relationship that justifies the processing of data ends, this data shall be blocked in accordance with the regulations, once the legally-established period has passed, they shall be deleted.  The data shall not be passed on to third parties except in the case where there is a legal obligation.

 The regulation for data protection provides the holder of the personal data with the following rights:

 ·          Right to revoke any previously given consent.

·          Right of access: Know what type of data is being processed and the characteristics of the processing that is being carried out.

·          Right of rectification: The ability to request the modification of the data if it is incorrect or untrue.

·          Right of portability: The ability to obtain a copy of the data being processed in an interoperable format.

·          Right to limit processing in cases which they consider unnecessary.

·          Right to cancellation: Request the ending of the data processing and its removal when its preservation is no longer necessary.

o    This notification should include the following information: Name and surnames of the user, the request, the address and the accredited data.

o    The exercise of rights should be done by the user themselves. However, it may be done by a person authorised as a legal representative of the authorised party. In such a case, the documentation that accredits the representation of the interested party needs to be provided.

 

 

AIMS OF DATA PROCESSING:

 ·          In the following, we explain the aims of the processing of data undertaken by some or all of the Parties Responsible for Processing listed earlier on:

o    EMPLOYMENT MANAGEMENT: Management of the employment relationship with the employees; processing of the data necessary for the maintenance of the employment relationship: management of payslips, training…The data provided shall be preserved for periods stated by fiscal and employment legislation and those necessary to meet legal obligations.

o    FISCAL ACCOUNTING MANAGEMENT: Administration of the data necessary for the compliance of the fiscal and accounting obligations of the business. The data shall be preserved for periods stated by fiscal legislation.

o    CUSTOMER MANAGEMENT: The ability to bill contracted products and/or services. Administration of product warranties. The data provided shall be preserved as long as it is necessary to guarantee the quality of the product or for the time required to comply with legal obligations.

o    MANAGEMENT OF POSSIBLE CUSTOMERS / CONTACTS: Administration of the necessary data for the ability to send them information related to our products and services by any means available, send quotes for services and/or products, and invite them to events that may interest them. The data provided shall be preserved as long as its processing is not requested to end.

o    VIDEO SURVEILLANCE: Safety of employees and goods of the business. Images taken by the video surveillance system installed in the business with the aim to protect its assets. The data shall be preserved for a maximum of a month from its recording.

o    RELATIONSHIPS WITH PROVIDERS: Administration of data of providers to be able to make orders and bill services. The data provided shall be preserved as long as a commercial relationship exists or for as long as necessary in order to meet legal obligations.

o    SELECTION OF STAFF / HUMAN RESOURCES MANAGEMENT. Administration of the data of participants in the processes of staff selection and the administration of CVs and other information provided by candidates for a position and to maintain them informed of the different position vacancies that arise in our organization. The data provided shall be preserved until the adjudication of a position or until the right to cancellation of this data processing is exercised (in no case shall it be more than a year). In every moment, the candidate may oppose or limit the reach of the data processing.

o    ELECTRONIC BUSINESS MANAGEMENT. Administration of the necessary data to be able to complete the management of the online shop, process the orders and sending of them. The data provided shall be preserved as long as a business relationship exists or for the time required to meet legal obligations.

    • PREMIUM CARD CUSTOMERS MANAGEMENT. Administration of data so that customers who take advantage of this card may enjoy discounts related to it, the ability to send information regarding promotions / offers, and congratulate them on specified dates. The data shall be preserved as long as the holder does not request the cancellation of its processing.
